The High Court of Uganda, sitting at Mbarara, has ruled that a continued and prolonged interdiction in an employment relationship is unlawful in Civil Suit No. 015 of 2016, Kamugisha Demian V Kiruhura District Local Government.
The court observed the following while arriving at its decision;
There is no problem with interdiction so long as it is done following the applicable laws and regulations in the Uganda Public Service standing orders 2021.
The investigations during the interdiction period must not exceed six months.
After the expiration of the six months and investigations are not concluded, the interdiction must be lifted.
The right to a fair hearing must always be respected, allowing the employee to be heard.
The overall effect of lifting the interdiction is that the employee must be reinstated on his or her Job.
